These Terms of Service (“Terms”) govern your use of the Weather InTouch website (weatherintouch.com), web application (app.weatherintouch.com), backend API (api.weatherintouch.com), and mobile apps (together, the “Service”), operated by Martin Hubálek, a self-employed individual (OSVČ) established in the Czech Republic, Business ID (IČO) 08827303 (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old (or the minimum age of digital consent in your country) to use the Service.
2. Your Account
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. We support sign-in via Google and Apple, and you must comply with their respective terms. Please notify us immediately at support@weatherintouch.com if you suspect any unauthorized use of your account.
3. Subscriptions and AI Credits
- Plans. The Service offers a free tier and paid subscription plans. Paid features, limits, and pricing are detailed on our pricing page.
- Billing. Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe. Your subscription will renew automatically until you cancel it. We do not store your payment card details.
- Cancellation. You can cancel your subscription at any time through your account settings. Your cancellation will take effect at the end of the current billing period, and you will retain access to paid features until then.
- AI Credits. Certain features consume AI credits. Credits included with a subscription are granted per billing period. Separately purchased credit packs are one-time purchases and remain valid for 12 months from the date of purchase, after which any unused credits expire. Credits have no cash value and are non-transferable.
- Refunds. Subscription fees already paid for the current billing period and used AI credits are non-refundable, except where statutory rights apply. If you are a consumer in the EU, you have a 14-day right of withdrawal from a purchase. However, for digital content and AI credits, this right ends once you begin using them with your prior express consent and acknowledgment that you lose your right of withdrawal. Statutory withdrawal or refund rights under applicable consumer law are not affected by this section.
- Price Changes. We may change our prices from time to time. We will provide you with reasonable advance notice of any price changes, which will apply starting with your next billing period.
4. Acceptable Use
You agree not to:
- Use the Service unlawfully;
- Resell or redistribute data beyond your plan’s terms;
- Abuse, overload, scrape, or reverse-engineer the Service or its API beyond documented limits; or
- Interfere with the Service’s operation or security.
5. AI Features
AI-powered features generate output automatically, which may occasionally be inaccurate, incomplete, or outdated. This output is provided for convenience only and does not constitute professional advice. Always verify important information against authoritative sources before relying or acting on it. Data you submit to AI features (such as your prompts and the locations you query) is processed solely to generate your results and is not used by our AI provider to train its models. 6. Third-Party Data and Services
The Service displays weather, alert, air-quality, and map data from third-party sources. These include forecast data providers (Open-Meteo, OpenWeatherMap), official national meteorological services that issue severe-weather warnings (including the National Weather Service (USA), ČHMÚ (Czech Republic), Deutscher Wetterdienst (Germany), MET Norway, Environment and Climate Change Canada, the India Meteorological Department, and Met Éireann), and map or radar tile providers. The countries for which we relay official warnings, along with the providers for each data type, are listed on our Data Sources & Coverage page. We do not control and are not responsible for the accuracy or availability of this third-party data. Your use of third-party integrations (such as Telegram or webhooks) is subject to those providers’ respective terms. For more details, please see our sub-processor register.
7. Weather Forecasts and Alerts — Important Disclaimer
Please read this section carefully — it governs how you may rely on the Service.
We do not produce, author, or independently verify weather data. The forecasts, nowcasts, and underlying observational data shown in the Service are generated by independent third-party providers and official meteorological services (identified in Section 6 and on our Data Sources & Coverage page). The severe-weather warnings we display originate from official government authorities and are relayed from their public feeds. We act solely as a distributor that aggregates, translates, and presents this third-party data substantially as received. We do not control this data and provide no independent warranty for it. Weather forecasting is by nature approximate and probabilistic, and the originating providers themselves do not guarantee the accuracy of their data.
Accordingly, the weather forecasts, nowcasts, watchdog alerts, and severe-weather notifications provided through the Service are for informational purposes only. They are:
- Not guaranteed — We do not warrant the accuracy, completeness, timeliness, or reliability of any forecast, alert, or data. We provide no warranty regarding the underlying third-party data, which is inherently uncertain and is provided without guarantee by its originators;
- A prediction, not a guaranteed outcome — A forecast or alert is a probabilistic prediction based on data covering a wide area and a future point in time, not a statement of fact about what will happen. Actual conditions at your specific location may turn out milder than predicted (a forecast event, such as rain or a storm, may not occur at all), or more severe than predicted (conditions may exceed what was shown, including hazardous weather occurring at your location without any corresponding forecast or alert having been issued). This applies to all weather elements, including temperature, precipitation, wind, storms, and other severe-weather phenomena. Neither the presence nor the absence of a forecast or alert for your location guarantees what will actually occur there;
- Not a substitute for official warnings — They do not replace, and must not be used instead of, warnings and guidance issued by official government meteorological services, civil-protection authorities, or emergency services;
- Dependent on delivery — Alerts rely on third-party networks (such as push notifications, email, messaging, and SMS) as well as your device and settings, and they may be delayed, undelivered, or fail entirely. You must not rely on the Service as your sole or primary source of information for safety-critical decisions.
You assume all risk for any decisions and actions you take based on information from the Service. To the maximum extent permitted by law, we are not liable for any loss or damage arising from your reliance on any forecast, alert, or other weather information, or from any inaccuracy, error, omission, delay, or unavailability in the underlying third-party data. In an emergency or severe weather situation, always follow the instructions of official authorities.
8. Intellectual Property
The Service, its software, design, and content (excluding third-party data and your own content) are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, or if necessary to protect the Service. Upon termination, your right to use the Service ceases immediately. Any sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will continue to apply.
10. Service Availability and Disclaimer of Warranties
We want the Service to be available whenever you need it, and we use commercially reasonable efforts to keep it running, to carry out maintenance carefully, and to restore the Service promptly after any interruption. Where practicable, we will aim to give advance notice of planned maintenance and to make information about the current operational status of the Service available. However, we do not guarantee that the Service will be available 100% of the time, or that access will be uninterrupted, timely, secure, or error-free. Availability may be affected by maintenance, updates, technical failures, and circumstances outside our control — including the third-party data sources, networks, devices, and infrastructure on which the Service depends.
We do not provide a service-level or uptime guarantee for either the free or the paid tiers. Temporary unavailability, interruption, or reduced performance of the Service does not, by itself, entitle you to a refund, credit, or other compensation, and we do not refund subscription fees or AI credits on account of downtime. Your mandatory statutory rights as a consumer — including any right to a remedy or price reduction where the applicable law provides one — remain unaffected.
Except as required by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months preceding the claim or EUR 100. Nothing in these Terms limits liability that cannot be excluded or limited under applicable law (such as for death or personal injury caused by negligence, or for fraud), and your mandatory statutory consumer rights remain unaffected.
12. Changes to These Terms
We may update these Terms from time to time. We will post the revised version with an updated effective date and notify you of any material changes. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree to a material change, you may reject it by cancelling your subscription and discontinuing use of the Service before the change takes effect; you will not incur any penalty for doing so.
13. Governing Law
These Terms are governed by the laws of the Czech Republic, and any disputes will be subject to the jurisdiction of the courts of the Czech Republic. This choice of law does not affect any mandatory consumer protection rights you may have in your country of residence.
